Tom Sizemore and Heidi Fleiss Settles Suit


More Tom Sizemore news...


It has been reported that Sizemore and former madam, Heidi Fleiss, have settle.

According to MSN.com, papers in filed Friday in court states that resolutions were reached. As of right now, the terms have not been disclosed (wonder if Smoking Gun will have it by this afternoon???).

In a lawsuit filed in 2004, Fleiss alleged she suffered emotional distress after the "Black Hawk Down" actor threatened to contact authorities to try to have her probation revoked. Fleiss also claimed Sizemore destroyed or gave away her furniture.

Bobby Sues Whitney for Custody


Just when we all thought things were quiet...

Bobby is suing Whitney because he is unhappy with the custody arrangement set in the April 4 divorce. Houston was granted sole legal and physical custody of their 14 year old daughter, Bobbi Kristina.

In documents filed Apr. 26 in Orange County Superior Court, the 40-year-old former New Edition member says that financial and emotional problems kept him from responding to Houston's divorce petition in time.



"It was no secret that I (as well as Whitney) had financial commitments
which we could not meet," the suit reads. "Additionally, after Whitney and I had
separated, I had no where to go and very little money to live on. I was, for all
intents and purposes, homeless. My marriage had fallen apart, I was without a
home, I had no money, and I was experiencing legal problems associated with my
child support obligations. It is no wonder that by the end of 2006 I had become
distraught and depressed."

A court date for Brown's new case was set for June 15.

IMO, Bobby had no excuse, he could have call the court and explained his situation. If he wanted to see his daughter, he would have walked or danced his way to court. Whatever, Bobby!!

Kim Kardashian Drops Lawsuit Against Distributor


Infamous socialite and on-and-off BFF to Paris Hilton, Kim Kardashian has accepted $5.5 million from Vivid Entertainment. She filed the lawsuit over the release of a sex tape with former boyfriend and new lover boy toy to Whitney Houston, Ray J.


The sex tape, made years ago, will be available to consumers until the end of May.

Beyonce Pulls 'B'Day Deluxe' due to Lawsuit


Beyoncé's release of her "B'Day" Deluxe Edition album has been pulled off the shelves due to the pending lawsuit filed by Des'ree. The singer is accusing Ms. B of copyright infringement.

Beyoncé recorded the track for her album and named it "Still in Love (Kissing You)." Des'ree claims that Beyoncé's team never got a full clearance to use the song.

MTV.com details the lawsuit: According to the suit, Beyoncé's team originally sought clearance on February 13 to use "interpolations" of the Des'ree song, which became a hit when it appeared in the Leonardo DiCaprio/ Claire Danes movie "Romeo + Juliet" in 1996. Lawyers for the two sides (Beyoncé and Des'ree's publishers the Royalty Network) started talking, and by March 3 — a month before Beyoncé re-released her album — Beyoncé's side had a "confirmation letter and license request" ready to submit.
On March 5, the Royalty Network's lawyers answered by submitting a counter proposal in which they granted permission — within certain limits. For one thing, they would allow use of the song, but not in video form. They would also allow use of the song only if the title were not changed. The Royalty Network's lawyers at Epstein Levinsohn Bodine & Weinstein said in the complaint that "despite follow-ups," they didn't hear back from Beyoncé's camp. And on March 27, according to the complaint, they discovered that Beyoncé and her record label planned to proceed with their plans to include the song on the re-release anyway.


In a letter they wrote to Beyoncé's lawyer and her distribution group Sony, the Royalty Network called the move "completely unacceptable."
"First, no agreement has been reached in connection with [the song]," the letter read, "and Sony has no right to proceed ... absent an agreement. Second, the retitling of the composition puts TRN at risk for claims from more than one third party, and this is a risk that [Beyoncé] and Sony were or should have been aware of in light of the circumstances surrounding the discussions relating to this potential license."


The Royalty Network then asked Sony to cease and desist from distributing the album with the song under a new title, and when Beyoncé and her label did so anyway on April 3, the Royalty Network deemed that "willful disregard." So a new letter was sent that day, saying the offer to allow Beyoncé to include the song on her album was withdrawn.

Then there was the matter of the Cliff Watts-directed video of "Still in Love (Kissing You)" on Beyoncé's "B'Day Anthology Video Album," which was sold separately at Wal-Mart. The video, which was shot on the beach in Miami, "feels like something you shouldn't be seeing," Beyoncé told MTV News — meaning that it seemed like a home video because it was so "raw" and "natural." But the Royalty Network felt like it was something that shouldn't be seen for a different reason — because they hadn't granted audiovisual rights even when they were leaning toward letting Beyoncé use the song. In a letter sent April 6, the Royalty Network called it a "blatant violation of the terms" they had set forth.


After filing the suit on April 16, the Royalty Network — which seeks $150,000 in damages and an injunction to recall the deluxe edition from stores — came to an agreement with Beyoncé's camp, filed Friday with the court, that Columbia and Sony would "engage in no further distribution" of the album or video anthology with the song in question, at least until a preliminary injunction hearing May 4.


Update!!!! As of April 27th, Beyoncé's management company released a statement Friday stating the much disputed single 'Still in Love (Kissing You)' will not be on the new shipments of 'B-Day.' Versions of her album released internationally will not be affected.

"Unfortunately, there were some misunderstandings regarding whether Des'ree's song '(I'm) Kissing You' was cleared for release in the United States," said Music World Entertainment, which represents Beyoncé.

Hank Fasthoff, one of Beyonce's attorneys, said: “First and foremost we’d like to point out that as an artist, Beyonce is not in any way involved in the process of obtaining clearances to re-record and release songs. Obtaining clearances is customarily handled by management, the attorneys and/or the label.


“However, until this clearance situation is resolved, future distributions of the album/DVD in the United States will not include ‘Still In Love (Kissing You).’


“The international market is not affected in any way because the song is not included on albums shipped outside of the United States.”

Damon Dash Files Multimillion Dollar Lawsuit against Accountant


Former Roc-A-Fella mogul Damon Dash has filed a lawsuit against his accountant.

According to New York’s Daily News, Dash filed a $3.5 million lawsuit with Manhattan Supreme Court against Barry Klarberg, claiming Klarberg filed erroneous tax returns and failing to tell him how much he profited from the sale of one of his companies. Dash sold his shares in both Roc-A-Fella Records and Rocawear clothing in 2004.

Loring Ward, a wealth management firm founded by Klarberg, is also named as a defendant in the suit.

Des'ree Suing Beyoncé for Copyright Infringement


Just when you thought things couldn't get any worse for Ms. B.

The singer is being sued by Des'ree for copyright infringement. According to legal documents filed in New York, Des'ree claims that Beyoncé never obtained proper clearance to cover her song, "I'm Kissing You." Also, Des'ree and her reps claim that Beyoncé and her record company people tried to work out a deal, but it fell through.

Des’ree is most famous for her 1994 smash hit, “Gotta Be.”

Beyoncé’s song, “Still in Love (Kissing You),” is featured on her album, “B-Day – Deluxe Edition.” Des’ree’s version was used in the 1996 film, “Romeo and Juliet.”

Des’ree is seeking $150,000 in damages and halting the distribution of the song, video, and album.

Howard K. Stern Files Slander Suit

Howard K.Stern, former attorney and companion of Anna Nicole Smith, has filed a slander lawsuit. The suit is against an attorney for Smith's mother who has suggested he had a hand in Smith's death.

According to the lawsuit, O'Quinn appeared on several national television shows in which he suggested Stern murdered Smith. During an interview in Fort Lauderdale, O'Quinn told Fox News Show's Greta Van Susteren that Arthur believed Stern had murdered her daughter and that O'Quinn agreed with her. O'Quinn also suggested on MSNBC that Stern had ulterior motives for wanting to see Smith's will days before Smith died.

"The public airwaves should never be used to promote personal agendas or vendettas," Stern's attorneys L. Lin Wood said in a statement issued Friday.
